Probably because "other" people can smell it on them..
but I know our Walmart in Las Cruces allows them to [sign in to see URL]'ve seen employees sitting outside around the [sign in to see URL] have picnic tables set up and everything.

What about someone who doesn't smoke, but you can smell smoke on them because they live with smokers? I'm sure a lot of Wal-Mart employees still live with their parents, and those employees wouldn't have any control over it.

Someone I hadn't seen since before my trip asked me about a week ago if I had quit smoking. He doesn't smoke, and he didn't smell it on me, even though I had just finished one on the drive there.

Do they do random tests for nicotine? If not, then a non-smoker might be fired for smelling like smoke, but people who do smoke might get away with it.

Either way, I just think it's stupid. If something is legal, then people should be able to do it on their own time. Next thing you know, they'll be firing people for having a glass of wine at a wedding reception, or for tanning in a tanning bed. emoticon

If it is a legal public activity then companies have no business telling the employee they cannot do it when they are not working. Total control like that is like being a slave so no way would I work for them.

BTW - I do not smoke.
